Kenya Property Buying Guide: What Non-Citizens Can Hold and How to Check Title

Buying Property in Kenya as a Foreigner: Leasehold, Land Control and Stamp Duty

Kenya buying guideUpdated October 2026

Non-citizens cannot hold freehold land in Kenya, and the government has told foreigners to convert freehold titles into 99-year leaseholds. Rural land is more restricted still. For city apartments and houses, however, the leasehold limit is a manageable constraint. This Kenya property buying guide covers tenure, the stamp duty rates, the digital land system and the fraud risks that catch buyers out. See listings on our Kenya page.

Leasehold is the ceiling

Article 65 of Kenya's constitution limits non-citizens to leasehold interests of up to 99 years. A company counts as Kenyan for freehold purposes only if it is wholly owned by citizens, so buying through a company with foreign shareholders does not evade the rule. In January 2025 the lands minister directed foreigners to surrender freehold titles for conversion into 99-year leases, saying the government did not intend to dispossess them of land legally acquired. One source claims foreigners can buy freehold, but others, and the official statement, point the other way.

In practice, flats in Nairobi, Mombasa and Nanyuki are often sold on long leases anyway, so a foreign buyer of an apartment may notice little difference. The issue bites with houses on freehold plots and with farms.

Agricultural land is defined broadly as land outside municipalities and townships. Dealing in it requires Land Control Board consent, and the board must refuse where the recipient is not a citizen. So a foreigner cannot buy a farm, a ranch or a rural plot outright. Leasing may be possible, but get a lawyer's opinion.

Searching and buying with Ardhisasa

Kenya has moved land records onto the Ardhisasa digital platform, which allows searches, stamp duty payment and transfers online. Fraud still thrives, so use it with a lawyer.

  1. Instruct an advocate registered with the Law Society, not just a land agent.
  2. Conduct an official search at the land registry or via Ardhisasa to confirm the registered owner, encumbrances, caveats and the title number.
  3. Do a survey check. Confirm boundaries with the surveyor and check beacons on the ground.
  4. Visit the county government for rates clearance and any planning approval.
  5. Sign the sale agreement. The Law Society conditions typically require a deposit of 10%, with completion in 90 days.
  6. Obtain consents. Land Control Board consent for agricultural land, and, for leaseholds, the lessor's consent.
  7. Value and pay stamp duty online, then lodge the transfer.
  8. Receive the new title in your name.

Watch for fake titles, double allocations and sellers using forged identity documents. Insist on meeting the registered owner.

Stamp duty and other costs

Stamp duty depends on location, not on who the buyer is. Municipal boundaries were widened in 2024, which moved many areas into the higher rate, so check whether your plot is inside a gazetted municipality.

Money, residence and risk

Kenyan banks lend in shillings, at floating rates that follow the central bank rate, and foreigners with a work permit and local income find it easier than non-residents. Our Kenya financing page explains what lenders require, and the mortgage calculator shows the impact of higher rates. Remittances out can involve paperwork, so keep the purchase and sale documents.

Owning property does not give a right to live in Kenya. Residence is through work, investor or other permits. Kenya has a Class G investor permit with capital requirements, but you should confirm the current rules with the immigration department.

The main risks are title fraud, off-plan project failure, service-charge disputes in apartment blocks and flooding in some Nairobi neighbourhoods. For context, see the Kenya market analysis. Entry-level options are on our cheap and under-100k pages.

Mistakes that cost foreigners money

  • Buying freehold in your own name and later being asked to convert it.
  • Setting up a company with a Kenyan nominee to hold freehold, which can be unenforceable.
  • Paying a deposit to a 'project manager' with no verified title.
  • Skipping the county rates clearance.
  • Buying off-plan without checking the developer's land title and approvals.
  • Missing the municipal boundary change that shifts stamp duty from 2% to 4%.

Frequently asked questions

Can a foreigner buy land in Kenya?

Non-citizens can hold leasehold interests of up to 99 years, not freehold. Agricultural land outside municipalities is effectively closed to them without citizen status.

What happens if I buy freehold as a foreigner?

Government statements say freehold titles held by foreigners are to be converted into 99-year leaseholds. Get your advocate to confirm how this affects your plot.

What is stamp duty in Kenya?

4% of value in municipalities and 2% in rural areas, paid by the buyer online. Many towns were moved into the 4% category after a 2024 boundary change.

How do I avoid land fraud?

Use an advocate, run an official search on Ardhisasa, meet the registered owner, verify identity documents and inspect the survey beacons on site.

Can I buy through a company?

A company counts as Kenyan only if wholly owned by citizens. A company with foreign shareholders cannot hold freehold.

Does buying property give me residency?

No. You need an appropriate permit, such as work or investor classes. Ownership alone does not grant a right to reside.
